DISCLAIMER

1 〙 Whether you have read my Terms of Service or not: by purchasing, selling, trading, or using resources made by me, you agree to the terms listed below.2 〙 I do not have to notify you nor give you a reason for blacklisting or blocking from my account, and subsequently being banned from purchasing or owning any more designs. I have the right to blacklist with reason, but you also have the right to appeal or message me on my discord shown in my user profile of overwriting terms of service or clearing misunderstanding, but I reserve my right to not respond if I choose not to.3 〙 I may not background check someone before accepting commissions or trades. However, if you are problematic, it will result in a swift blacklist and block. Yes, I know it may be hard to keep track of. But please try to avoid re-selling or re-trading designs made by me to these blacklisted people.4 〙 Please excuse any grammatical errors, English is not my first language!5 〙 Please avoid casual conversation outside of business if we are not mutuals or friends; I am a very awkward person and not a fan of small talk.

BLACKLIST

Refrain providing my products to these people. Accidents happen, but if it is revealed that you have purposefully done this as voucher or any other reason, you will be added to this blacklist.

GENERAL USAGE AND MISCELLANEOUS

1 〙 I, the artist, have the right to display commissions or designs on my portfolio(s), carrds, art examples, etcetera unless explicit request not to is requested.2 〙 NFTs or AI may not be used, you, the client, may not feed my work into generative AI training, or sell my artwork for any sort of cryptocurrency.3 〙 What the client does with their art is no longer my responsibility, if anyone who owns commissions or designs that are made by me and end up being problematic, do not associate their behavior or allegations with me.          3A 〙 The client may not re-sell designs that were made by me for a higher price than it was set or paid for unless extra art has been attached to the design.          3B 〙 The client is allowed to edit designs to their liking, what the client does with their art is no longer a concern of mine as it is their owned design now.4 〙 I reserve the right to deny a commission for any reason; some reasons including that I feel the design may be too complex or if I feel I cannot provide a product that can fully do the particular commission justice.5 〙 I will not work on strict deadlines unless I explicitly agreed to it. I prefer to take my time and avoid burnout. I will not work on a specific timeline as life does tend to throw curve balls at me like I'm a MBL baseball player.          5A 〙 My preferred method of contacting is discord, toyhou.se private messages, or Instagram private messages with the quickest response guaranteed to come from discord messages.          5B 〙 While discussing, the client is encouraged to avoid typing quirks or using unreadable fonts.          5C 〙 The artist encourages the client to use English or Korean as the only language used while communicating.6 〙 DO NOT remove designs transferred via toyhou.se off of the platform, even if you have another site to put them in.

PAYMENT AND REFUNDS

1 〙 I will cancel the commission if:
          i. I cannot complete the commission for any reason
          ii. the client declines payment method
          iii. I feel uncomfortable in any manner or if the client feels uncomfortale in any manner
          iv. a terms of service is broken2 〙 Discussing refunds:          2A 〙 You will be supplied in full if I am unable to continue the commission, no matter the reason behind inability to.          23B 〙* Cancelling the commission on the client's end will result in a 60-100% return depending on the progress of the commission. Commissions take time, time I will not get back.
          i. medical reasons, losses, etc. can expect a full refund.
          ii. if this is the reason, lying about such will result in a ban.3 〙 Payment is expected within the first 72 hours by the time the first acknowledgement message to the final piece. Reactions count to this time limit.
(EX.) saying there is no complaint, and like it how it is, the time limit will start
(EX.) reacting to the final piece with a heart on discord, the time limit will start4 〙 When purchasing designs from me, payment/offer is accepted within the first 48 hours of the offer being accepted. I will not do holds longer than two week unless you're a trusted client or friend.5 〙 After the commission is mutually finished, I am not responsible for your spending habits or financial standing. I will not provide refunds or chargebacks after commission and payment is finalized.6 〙 Complexity fees may be added, ranging from a minimum to $5 and a maximum to $15.7 〙 Do not resell any of my designs that are higher than the original price unless original artwork was added. Selling for less is fine.

PROGRESS AND CHANGE

1 〙 Payments are required after the client approves the sketch. I will always provide the sketch before lining and coloring. However, you may also provide payment before seeing the sketch if they so choose to. I will not continue drawing until payment has been made.          1A 〙 The client is encouraged to request edits to the sketch if they see something they would like to be changed. Edits may be made even after the color and lineart is finished, but large edits cannot be made.2 〙 After lining and coloring is complete, I will share the final result; if the client is unsatisfied, minor changes or additional requests may be made.
          i. variations of overlay, foreground/background, with & without effects
          ii. incorrect colors or incorrect lineart
          iii. missing details
          iv. decreasing or increasing the canvas size
          v. cropping
          vi. any changes not listed on here can be brought up to by me3 〙 Within the sketch phase, as many edits may be requested. There is no limit.

DOs And DON'TS

I will do eyestrains, but only eyestrain characters like fullbodies, chibis, etcetera. I will not draw eyestrain backgrounds, this is for my comfort and my eyes 😭
